Kopite Posted May 8, 2006 Share Posted May 8, 2006 Our store is opening Sundays 11-4pm but the staff will not be getting any breaks or dinner time. Just wondering on the legality of this; can people be made to work through what's considered to be lunch time without any food? I think the law was changed saying that people can go a maximum of 6 hours without a break. Is this now the case? So is there any cause for us to complain as the staff are proper pissed off about it. Lucifer Posted May 8, 2006 Share Posted May 8, 2006 An employee aged 18 years or over is entitled to a 20 minute undisturbed break for every 6 hour shift they work. They are also entitled to 11 hours rest between each work day and are further entitled to one full day off each week. An employee aged less than 18 years old (from the minimum age of leaving school) is entitled to a 30 minute undisturbed break for every 4.5 hour shift they work. They are also entitled to 12 hours rest between each work day and are further entitled to two full days off each week. Employees are not liable to have toilet breaks without the consent of their employer. However, for the sake of your employees' health, it is better for them to use the toilet freely. MONKEYmark Posted May 9, 2006 Share Posted May 9, 2006 at our work they say you entitled to 15 min break every 4 hours.so they do it so they only had to give us 30 min break in 12 hour shift.worked right that the 3rd break was at end of your 12 hour shift. but now we have 2 20 min breaks.yet the office staff have 1 hour break. they also used to let stinking smokers have a 5 min cig break every hour where the none smokers dont get anything.they were getting like over an hour a day.now they phasing in where you can have 3 fag breaks.then next month 1 fag break.then month after its complete no smoking. Ian R Posted May 9, 2006 Share Posted May 9, 2006 Rest breaks 12. - (1) Where an adult worker's daily working time is more than six hours, he is entitled to a rest break. (2) The details of the rest break to which an adult worker is entitled under paragraph (1), including its duration and the terms on which it is granted, shall be in accordance with any provisions for the purposes of this regulation which are contained in a collective agreement or a workforce agreement. (3) Subject to the provisions of any applicable collective agreement or workforce agreement, the rest break provided for in paragraph (1) is an uninterrupted period of not less than 20 minutes, and the worker is entitled to spend it away from his workstation if he has one. (4) Where a young worker's daily working time is more than four and a half hours, he is entitled to a rest break of at least 30 minutes, which shall be consecutive if possible, and he is entitled to spend it away from his workstation if he has one. (5) If, on any day, a young worker is employed by more than one employer, his daily working time shall be determined for the purpose of paragraph (4) by aggregating the number of hours worked by him for each employer The legal document will find this on is the European Working time Directive. I believe from memory 1998 is the latest edition.
