tbourner
Effectively he was using self defence and instant arming, and he used similar force to that which he felt he was at threat from. Same would happen in your home I believe. The problem is you're not allowed to PRE-arm yourself when you hear an intruder, and go down to meet them with the intention of doing harm - and I think you should be allowed to!!! Lbm
That ridiculous!! Indeed, however: "Those who use reasonable force in defending themselves will enjoy the full protection of the law" - John Dilworth, CPS I think reasonable force is a flexible term
Charlotte
Is this a similar case to that man on the farm with the gun that went to prison. Sorry that's vague, Tony Martin?

So its a case of "Wait a moment, while I go and get myself a 'weapon' of some sort. Try not to break anything while I'm gone." That's nuts I'll be 'prepared' before I even get that far! EDIT: I'm pleased for Mr Singh though. He must've been worried sick.

IIRC, I think he shot one of them in the back as they were trying to escape...so it didn't quite come across as self-defence.

That's nuts Pretty much. If you get woken up by noises downstairs for example, you're supposed to walk downstairs in your pants to see what's going on, then try and reason with whoever is there (I assume), and if they come at you with intent to wound you then can pick up whatever is nearby and thwack them with it!!!! Or just tell the police that your ali baseball bat just happened to be leaning against the wall where he attacked you! Rather than under the bed where you normally keep it. lust2luv
So the lesson is to keep baseball bats strategically placed around the house then.

Conrad
We've been burgled a few times in the past and since then my Dad keeps a baseball bat by the side of his bed. He mentioned this in passing once to our soilicitor who we see a lot through work. She then told my Dad that if he was to attack an intruder with it he would be prosecuted. Although, if it was my Mom who attacked the intruder (or my Mom just said it was her ) then that's classed as self defense because she's a women and wouldn't be able to defend herself properly without it. Worth knowing I guess...

marc_p
http://news.bbc.co.uk/2/hi/uk_news/england/7266555.stm I know that the outcome of what happened here was how it should be. But, I already know I'm going to get a55 raped for what i'm about to say here but I feel I should. Don't you feel the outcome might have been different if the races were reversed? johnny g
Hopefully not. The scum who entered the house broke the law - a man (or woman) should not be charged for attacking an intruder in their own home. Race is ultimately irrelevant. Konrad
What about old rule "my home is my castle"? I always tought, that if there is intruder in my house, I have every right to use any force or weapon to get rid of him. He shouldn't be there in a first place! I do not really give a $#@$% about stupid lawyers, I would just kill b@#%rd so he cannot complain

I'd wander round with a decent torch like a maglite - "I was using it to light the way officer. It just happened to be conveniently to hand when he attacked me, so I hit him with it!"
