Legal minds-Drinking in a car question?

I guess the sort of scenario where maybe you are having a lift home but still not quite finished your night out and therefore may wish to finish of your bottle whilst being driven home.

Could a police officer pull you over and legally stop the passenger drinking.

I suspect that it is not illegal to drink as a passenger unless you are seen to be causing a nuisance or possible danger to the driver.

It's not illegal for the passenger to drink.

However, if he's impeding the driver in any way the police could arrest him for being drunk and disorderly, and the driver could be done for driving without due care and attention for allowing someone in that state to be in a popstion to interfere with his driving.

 

PS, it might be the wrong answer, but you've got to admit it makes sense.:)

I personally wouldn't have anyone who is drinking in a car...

 

Needless to say a 'mate' of mine pulled the handbrake on the car on the way home one night thinking it was funny as we went over the railway line...

 

The car spun all over the road and narrowly missed the kurb.. (Wasn't the supra)...

 

He was asked to get out of the car after getting a smack in the gob for being a complete and utter prick.

It is only illegal in certain states of the USA to have an open container of alcohol in a vehicle.

However although not illegal in the UK if the car was to be stopped and the passenger was/had been drinking alcohol I would expect the Police to breathalise the driver as their suspicion will have been roused.

As has been said before I wouldn't allow passengers to drink alcohol in the car from a safety aspect more than anything. Especially a front seat passenger.

What about when your boyfriend and brother decide to stop at an off licence because they need to stay 'topped up' for the journey back round the M25 after a day out? Is it illegal to kick them out of the car after a particularly bad version of Bonnie Tyler's holding out for a hero?

so we were chav-ing it up on the way home..? and we spotted SupRo and jeered at him trying to get an Evo into battle over our cans of larger.... it was great!

 

We would have been asleep if we hadn't carried on drinking.. we did it for you! it was a safety measure.. ;)

Been pulled over when all passengers have been pissed out of their faces and with drink.

Driver was stone sobber.

Policemen didnt mind at all as was very good about it all. Said it absolutly stank of beer but didnt breathalize the driver as he could see he was 'normal'.
