baldy Posted March 18, 2006 Share Posted March 18, 2006 i know this is a long post but please read on ive just bought a cheap runnabout,sold as having had a headgasket cam belt & water pump recently done,it had next to no petrol in it when i got there so was told not to go too far on a test drive. it all seemed ok.so i bought it. on the way home i discover the heater dont get hot,oh well i thought,it also ran very cold on dual carrigeways once up to speed(thremostat stuck im thinking) the next day i take a look heater blocked.so sort that with a quick flush out with a hose,put a new stat in, still not right! i get a mechanic mate to take a look,he gets some tester out and says theres hydrocarbons in the coolant,looks like a headgasket mate! so im not f**king happy! this was bought off autotrader, man at home but classed as trade as he sold x amount of cars in a year,but he clams its a private sale sold as seen and tested do i have a leg to stand on here or have i had my pants pulled down,he has no paper work signed by me for the sold as seen and tested statement cheers for any advise in this matter baldy Link to comment Share on other sites More sharing options...
AJI Posted March 18, 2006 Share Posted March 18, 2006 did it state in the advert that it was sold as seen? if so he should have got you to sign something to say that you have agreed to that condition of the purchase. were there any words in the advert that say it runs fine, or does it admit to any problems with the car? it will all come down to what was in the advert.... ie. if it mentions that the car has any problems or not. RENAULT Clio 1.4 RT Automatic 5 Door, 68000 miles, with history, lady owners, remtoe locking, pas, full electrics etc, work done recently incs head gasket, water pump, cambelt etc etc, MoT and tax, pristine condition, (West Sussex). . . . . . AJI Posted March 19, 2006 Share Posted March 19, 2006 well in the advert there it states the head gasket has recently been done. if your problem is indeed the head gasket then you should be able to contact the people who supposedly "fixed" it in the first place. If this was the seller then you should have a good case for re-imbursment... ie. the head gasket was obviously a problem which the seller knew about. if the seller got a garage to do it and you have proof ie. a receipt then try contacting the garage. They will most likely deny all knowledge.. but the simple fact is that if the garage supposedly fixed the problem and it is no better (which it isn't) then take the evidence to a small claims court. (please check that you have a strong enough case prior to doing so). If the garage does take it back in and admit to faulty work then it should be done for free. AJI Posted March 19, 2006 Share Posted March 19, 2006 ah-- just re-read the advert.... it is a trader therefore he must abide by trade laws... therefore you'll have customer rights in your purchase. The car is stated to be in pristine condition.... it isn't ...therefore you have the right to give him it back in exchange for your cash back. He will have the option to repair the work (for free) or he'll have to give you your money back. I think this is how the law works.... anybody else like to comment ??
