Conrad
Anyone know about or have experience with this? My mate got done back in November for Drink Driving and was DQ'd for 2 years with 6 months probabtion. He's an idiot for doing it so no need to point it out - he did take a speed camera out in the process though! Anyhow, he informed his Probation Officer he was going away for 5 weeks to India over Xmas so wouldn't be able to attend his weekly meeting. She told him he couldn't have more than 2 weeks but like the tit he is he went anyway. So yesterday he gets of the plane in Heathrow to be greeted by 3 police officers who arrest him. Spends a night in the cell and due in court tomorrow. Any idea what will happen to him?

CJ
Did he have a suspended prison sentence for the duration of the probation? This may help: http://www.angus.gov.uk/atoz/swpdfs/GuidetoProbation.pdf
Conrad
Did he have a suspended prison sentence for the duration of the probation? This may help: http://www.angus.gov.uk/atoz/swpdfs/GuidetoProbation.pdf Thanks for that CJ, positive reading I think. No he didn't have a suspended sentence so they can't now impose that. Despite how it sounds the guy's 29 and never been in trouble with the law before, this DD was totally out of character. Hopefully the magistrates realise this and are lenient with him. Havard
I think he's better of going for the "misunderstanding" excuse and apologise profusely!! Otherwise I can see one of these being involved in his punishment!! http://img90.imageshack.us/img90/911/cactus1dp6.jpg I would imagine he's working and a british citizen so they'll probably throw the book at him.... CJ
He will be remanded in custody for breach of bail conditions What is the likely penalty for the breach?
Conrad
Most likely he will be remanded in custody for breach of bail conditions. At best he will get a pretty good kicking from the judge. He's not breached bail though has he? Sentence has already been passed....
marbleapple
What is the likely penalty for the breach? Sorry CJ I misread and thought they were dealing with a bail issue. Just ignore me
bigcol
If you breach your probation order you can be re-sentenced for the original offences plus a new charge of breaching probation, thats why most people who receive a probation/supervision order tend to keep to it as best they can because in most courts its looked upon as "an alternitive" to prison. sorry to give you bad news but after 9 years in the prison service you get to see a lot of people who get banged up for breaches of probation, hopefully your mate will just get a fine or community service
