Scottish Legal Advice??

Is anyone in the know about selling properties as I think I've been really stupid and missed out on a pile of cash that I could use to mod the Sup.

My flat went on the market for offers over £44000 on wednesday. Since then I've had about 6 viewings. The fourth ones seemed really keen as they'd like to convert it back to a shop for their business. They asked how much I'd be looking for to take it off the market, I said around £50000. They seemed ok with that and said they might get back in touch but they'd have to think about it. Seemed positive but I wasn't getting my hopes up.

Then todays couple came along and didn't seem to like it that much, picked the faults then went away. They then came back and said they'd offer £50,000 subject to survey if I'd take it off the market. I thought to myself bloody hell thats good and it'll get me moving sharpish. Stupidly shook the guys hand on it and said yes.

Three hours later the fourth couple came back and said they wanted to make an offer. I told them what had happened and that I wasn't sure where I stand on it. They offered £53,000 and said they'd put the offer in first thing on Monday morning.

Where do i stand now? can I take the higher offer or do I have to uphold the first? I know in England I'd be ok to go with the second but how does it work in Scotland. Am I bound to my stupidity?

Cheers

Dave

hey dave

im not 100% about it but im pretty sure you have to put a offer in a official manner e.g through the solicitor or in wrighting

i offer'd on a flat and the same happend and i lost out

i dont think there offer can stand verbally

hope you get it sorted out mate

and if in doubt contact a lawyer there first visit is free anyway

hey its better in youre pocket than anyone elses

besides it happens all the time just tell the other party there has been a higher bid

why dont you put a closing date on the sale and the top bidder wins?!:search:

i sold my last house that way and made a extra 7k on the 2nd highest bid

basically, unless they put an offer in to you solicitor then your not bound to them to sell the property. Same said for the other party involved. A hand shake only holds a gentlemans agreement and doesnt hold up in court. If the first party pulls out and youve told people its sold, youll loose more than 3 grand. Stick to your guns and get a bidding war going. Sounds like you have a prime bit of land.

Must admit I didn't think my wee 1 bedroom flat would do so well. Sure it's a nicely decorated place near the centre of Arbroath but I'm a bit overwhelmed.

Gonna see what the solicitor says but if what you guys are saying is right then I'll be a happy chappy and the car will have some new bits.

Cheers for the replies
