far Posted October 20, 2007 Share Posted October 20, 2007 Basically bought an Ipod off a guy on Ebay on the 10/10/07 - he reckons he has posted it a few days later (via 'recorded signed for delivery') He is scanning the receipt to me but if it has got lost in the post etc 1) who is responsible to get compensation from Royal Mail? The seller or buyer? 2) Can I get a refund from Paypal based on non delivery? As a tracking number has been provided but I have not received the item 3) If the seller hasnt insured the item to the market value who is responsible? Fargo Posted October 20, 2007 Share Posted October 20, 2007 1) I'd say the seller will get the compensation as he paid for the recorded delivery. 2) If you have not received the item, then yes you should get a refund from the seller (i guess via paypal dispute) 3) Again postal issues are the sellers problem. he paid for the service, he gets the compensation, its his problem. With what I understand Paypal dispute console seems to wash its hands of 'failed deliveries' - anyone had any first hand experience of gaining a refund it the item hasnt been delivered due to 'lost in post' scenario? p.s dude your names like mine! Unless the seller can prove that you signed for the item you automatically get your money back from paypal. I have done this many times. (4000+ feedback on ebay between my accounts) Yes I did pay by Paypal - I emailed the seller stating that I hadnt received the item and the seller sent me this: "Unfortunately you can't cancel payment because the item was posted on 10/10/07 and the tracking no is DL6149 1510 7GB. What happens in the post is really not the sellers problem. You need to track your item using the reference I have given you. If you need me to email you the receipt I can do so." Glad i've got a resident expert on hand ;-) Question - cant the seller just say it has got lost in the mail and provide the tracking number to proove he DID post it, therefore eliminating the Paypal refund? First Class recorded is only up to about £32 comp I believe? If he could wash his hands of this because he has sent it and provided a tracking number then that's crap, he could just take an empty box and post it to get a tracking number;) The tracking number should show it hasn't been delivered, if they had problems then it would be returned to sender. If first class recorded is only insured upto £32 then if it has gone missing then I dont think I will get the full value refunded and if I open a paypal dispute they will just ask him for a tracking number and then ask him to get compensation through royal mail - can anyone clarify this from past experience? marbleapple Posted October 21, 2007 Share Posted October 21, 2007 If you make a paypal claim it is the sellers duty to prove that you have recieved the item. The only way he can do that is by giving them a copy of the reference number which shows that you signed for the item. If you have not signed for the item paypal will automatically refund you and the seller automatically loses the dispute. Set by step process to claim for non receipt: 1. log into paypal. 2. copy the transaction id for the payment you made 3. go to resolution centre 4. report a problem 5. report a problem (again) 6. item dispute 7. paste transaction id 8. click I have not recieved anything from the seller. 9. continue through and file claim 10. once the claim is logged, go to resolution centre 11. click on claim 12. click escalate claim 13. wait until paypal refund (a couple of weeks) Link to comment Share on other sites More sharing options...

Otherwise it is not as easy you think that you will just get your money from pay pal. Paypal will have to investigate and if they find that the item was posted, they will ask you to follow it up with Royal mail. Dont just threaten, Do your part. I know ebay rules very well and that is why I have 100% feedback just like yourself. Stop treating me like I dont know the rules. Do your part, I have sent you the tracking number. Come to me when royal mail says I didnt send it" what he is saying is partly true, because ebay and paypal are the same company they tend to stick together and all they want is your money, if you have filed a paypal complaint proceedure (open dispute) the seller then has to prove he sent the item, the only way he can do this is with the tracking number, the problem is because no-one but the seller knows what is in the parcel, it could be just an old newspaper!!!!! As long as the seller provides proof to paypal that he posted the item then they dont give a shit, they wont even investigate it, its up to you to sort it with the seller and royal mail they just cover their own arses, i have been ripped off by paypal/fleabay on 2 occasions and will not use them unless i have no other way of paying for stuff (on here for example) they state that you are safe and protected up to £500 NAAHHH keep at the seller and royal mail because paypal are as bad as some of the scamming tw*ts on ebay.
