Rob Davey Posted June 9, 2006 Share Posted June 9, 2006 Ok some woman has just opened her car door into my other half's car as she was driving past. Problem is she is trying to put the blame on her! So has anyone got experience or ideas of how this can be sorted without it going 50/50? The damage is on the front arch, with none at the front of the car which is where you would expect it if she had driven into an already open door. supraaaaaaaaaa Posted June 9, 2006 Share Posted June 9, 2006 dont know the ins and outs of it, my misses got smacked into the other day reversing out of a parking spot she stoped and allowed th car to go past {in a private car park} and he reversed straight into her !!! but it was called 50 50 as she started to pull out even though he hit her side and she wasnt moving grrrrr if its 50 50 insurance win both ways as its 2 loads of lost no claims Link to comment Share on other sites More sharing options...

Guest mk47 Posted June 9, 2006 Share Posted June 9, 2006 correct me if im wrong - but if a claim is settled 50/50 then it goes down as a fault claim? this is because none of the parties pay out for the damages and the individual insurers pay out for their own policy holders? imo try and see if there was any witnesses.. but more than likely the insurers will see it as the drivers fault because the car which had the open door was stationary at the time. not too sure though. The door moved into the approaching car and hit the side of it... ...its going to go 50/50 basically with no witness.
