Tenant issues

One of the guys at work is having problems with a tennant... I explained this place is full of knowlegable types (and a few numbties!). Any solicitor types have any advice?

Have a tenant with a tenancy agreement from the previous owner/landlord of the property. Now, I and my partner own the property and where looking to increase the rent and have a fresh tenancy agreement in place with the tenant for 6 months. After explaining this to the tenant he has got in touch with either a solicitor or home housing/sheltered housing. The tenant has came back saying he is going to continue paying the previous landlords rent until the tenancy agreement runs out on 1st May 2008.

Questions

Where legally do I stand on this matter?

Do I have to accept the previous tenancy agreement and wait until it runs out?

When shall I serve notice to the tenant?

Should I get something in writing between myself and the tenant to agree on the previous landlord’s agreement?

Cheers boys & girls!

sorry for the delay in replying.

my letting department have lost a lot of staff recently and theres no one left with a brain.

However, I have e-mailed a friend of mine who has his own letting agency (used to be the manager here) but he's currently on holiday - typical !

He had his laptop with him (sad), but he said he'll talk to me when he is home on Tueday with your options.
