paul_y3k Posted September 5, 2007 Share Posted September 5, 2007 ok my mrs has been temping for a while and the current place offered her permy employment, but due to problems with the contract it was never signed and it's been 'being sorted out' for a while. She has now been offfered a much better job else where and accempted it. the question is, how much notice does she need to give ? Is she still on the temp contract (weeks notice) because the permy one was never signed ? Or is she still bound to the permy contract notice period of 1 month. we both hoping she can get away from their on the temp contract as it really is a hole of a place, but obvisly dont want to do anything to burn bridges etc. Quote Link to comment Share on other sites More sharing options...

If they expect her to have to give 1 months notice then great, if they are wanting here ASAP then I'd go with that. If she didn't sign and was never made permy then the contract ts&cs still apply. Eve Posted September 5, 2007 Share Posted September 5, 2007 If a new contract was never signed I think they would find it hard to argue (and probably can't be bothered) that her notice period was any longer than a week. If her contract is with a temping agency rather than directly with the company she is working for then she has even more chance of sticking to the week. Mrs H Posted September 5, 2007 Share Posted September 5, 2007 Did your wife put her issues with the permanent contract in writing, was the notice period one of the issues? Just be careful as you can be deemed to have accepted terms just by remaining in employment, as long as the employer can prove you were issued with the terms of employment. This is to cover employers for when staff don't have issues with terms etc. they just can't be arsed returning the paperwork! We get at lot of that at our place. She should discuss it with her employer, then she can't be accused of being unreasonable, compromise or negociation is usually the best way to get what you want and a good reference!
