What's my consumer rights?

Hi guys

 

Bit of a rant so bare with me. My graphics card gave up the ghost mid may and I returned it to http://www.Overclockers.co.uk as it was under grantee. Now I have built 3 machines using there parts and not once have I had a problem with them until now, I had an email from them on the 20/05/06 saying that it would take 7-10 days to process. I then chased it up on the 31/05/06 and was told that they are waiting for a replacement from their supplier. Chased again on the 08/06/06 just to see how they are getting on and was told "Please wait until the 28th day and if you still have not had a replacement by then, please email/ring and I can process your RMA further". So emailed them yesterday and you guessed it they are still waiting for their supplier. Am I right in thinking they are the ones legally responsible and not their supplier? Where do I stand as its now 40 days!

Blimey, Overclockers are usually ok. I have had to send a couple of things back, and usually get them back within a week or two! It probably is legit that they are waiting on suppliers. But would have thought you could call them up and ask for something different of the same value...

yeah I tried that but as its a 6800Ultra its now discontinued and the price I paid would get a 7900GTX but they will only swap it for same performance so they have sugested a 7900Gt (which is fine with me)

I used to work for a computer parts distributor and the general T&C says that they can take up to 30 days to just test your item. If its faulty then they have to replace it with as close as they can get to it (worse spec is not acceptable). If that can't happen then they carry out their warranty with their supplier and can wait 30 days for that to happen.

 

All in all you can have a max wait of 60 days (roughly) legally. If it goes over that limit they will offer something so as not to go to court.

 

If they offer an upgrade accept it if I was you ;)

 

**EDIT ** Prices don't matter when looking for a similar model, you must go with statistics on the card only!

hhhmm,im not 100% certain what the legal covering for returned computer parts is,( but im sure they still fall within the law )

however i know for 100% fact that all the electrical items i sell - i, by law if an item is returned - must give either a refund,. an exchange or repair within 7 days.

i know as fact as im a shop manager.

i think thats incorrect.

all and any items sold as NEW automatically by law must come with a 12 month guarantee ( at minimal )

you were within your rights to recieve a full refund,. plus cost of postage to send the item back.

if you had revieved a full cash refund then you could spend the money on anything you wanted.( not ltd by in store policies - inc processor speeds )
