When you select D or R , the gearbox goes into second , then into first or reverse , to stop the car lurching , this is controlled by the brake pedal switch , its also possible someone has shimmed the gearbox actuators to quicken the shift change at some point -there are other possibilities -usually the fluid levels and colour are start points

Fluid seems fine but when its cold the fluid level is still above the hot marker is that bad?

I dont think it was shimmed car is all stock even has his oem exhaust.

Could a transmission filter have some kind of effect on this?

 

You measure it on running engine I assume?

what colours the fluid ?

No, measure when running, and have changed gears a few times, put back into park and measure again with engine on. That will give a cold level. A drive and a blast for a while will give a hot level, and measure with the engine still on.
