Can't believe it, my sensible low mileage BMW is wrecked :(
I was driving steadily along the road when a car on the side road on my left jumps out of the road right in front of me! Couldn't have had even a second to react, so only managed to turn the wheel right a little before hitting her. She was turning right out the side road so crossing the road in front of me, the entire front of her car is caved in so I'm pretty sure it's her fault... even though she tried to blame me! Thats rich considering her first words were "I didn't even see you" :Pling:
Thankfully no one hurt, I've just got a stiff neck and for some reason a bruised knee. Hopefully no aches tomorrow. Insured through Sky so hopefully they'll be able to sort me out a hire car before the weekend (sister is due to give birth in a few days and my father goes into hospital for a major op, so need a car in the next two weeks).

The inner wing is folded up so can't see it being worth repairing, the car isn't worth very much even though it was mint.
She was in a Y reg megane, the whole front was caved in but she still managed to drive it home... Turns out she live 10 doors away!

Crap sorry to hear mate. I had this last year but had like 1 sec more to react and managed to throw the sup round the junction she pulled out on me from. I was raging especially when she floored it away sharpish.
her fault she pulled out on a give way sign, just get you insurance to start the claim against her staright away

Thanks Jon :thumbs: I didn't get the reg plate, but she was pretty clear that she was fully comp insurance (with Direct Line). I'll speak to Sky tomorrow and see what they say about a hire car. Will be in touch tomorrow mate

I would iomagine her insurance company will throw up all kinds of crap. I would keep those photo's up your sleeve until you need to argue Darryl. They will probably say that you were speeding or possibly went through the light on red. My argument would have been that if there was someone on the crossing then I would have another witness wouldn't I...??;)

She doesn't have any lights on her junction anyway so the vehicles on the main road will have right of way. The double white line that she has crossed shows this!!

My advise would be dont call sky. in the case of a total loss you will not get a hire car.
You need to use an accident management company and hope that they can sort the liability issue for you. If they cant then you claim the value of your car through your own insurance but they will keep you in a hire car until you get a check from your insurance..... you do have to accept a reasonable offer though.

Sore one mate.Just be thankfull it wasn't the Soop. If you were driving on a road and she turned onto it from a side road then it was in no way your fault as you would of had right of way,unless it was a give way.
Cheep repair for the BMW and a wee present for the Soop me thinks :)

I hate people who make false claims but I would still go to the doctors if I had taken a knock in a car accident for peace of mind. It's the long term effects that's the problem.

OK now they've admitted fault they will probably come to take your car away. Give them the supra then tell them you've changed your mind and you want it fixing now :D

Thanks again folks :) Got the hire car sorted for one week, so should have transport until next Friday. Unfortunatly as it's very likely the car will be written off I will have to hand the car back as soon as they send a cheque. This means I will be without a car for the easter weekend.. the time when I'm suposed to be visiting my sister and father in hospital (and also hopefully seeing my new niece)

She's with Direct Line, they have been superb so far. Very professional on the phone and sorted out a courtesy car in an hour of contacting me. NIG (through Sky) were helpful at the beginning getting the car recovered but today were absolutely shocking on the phone. One person I spoke to was possibly the rudest person I've ever encountered at a call centre :blink:

What was amazing today was that everyone I spoke to said I should make a claim for personal injury (3 people at the hire car company and even one at NIG - presumably because it was the other company paying). Even the Direct Line person seemed surprised when I said I was fine.

It can take up to 6 months for the full extent of any whiplash or more serious injuries to come out. Only the initial stiffness is an indication that there may be further problems in that area.
Tell the insurance company that you had pains and where they were, also tell them that you will see if there are any long term effects.
You don't want to be in my position with permenant (although its luckily low level) pain and no recourse to compensation :blink:

The impact wasn't a hard one, I glanced off the front of her car so there was no 'sudden stop' involved. The airbag didn't even go off. I doubt I was doing much more than 20mph when it happened.
My neck was a little stiff last night, but that was probably more due to adrenaline after the crash and standing in the cold for an hour. I felt absolutely fine this morning and the rest of the day, just a little pain in my knee and elbow from the bruises. I've had much worse after a weekend working on the supra :D

I know I am biased in this area but sueing the woman for negligent driving isn't just an injury claim. You are claiming for the inconvenience, the bruises, (her stupid driving), and the bruised neck.
Her insurance is there for a reason and any award you would be given would match the injuries and problems you have suffered as a result so if you are honest you are not ripping any one off. I.e. if it isn't a lot of damage then it won't be a lot of money.
At the end of the day if the law didn't think your claim was valid then you wouldn't be able to sue. If you can sue then you should on principle.

It just so happens that I am a trainee solicitor at the UK's leading personal injury/medical negligence firms so I would be slightly biased.
I am against people who claim for injuries and fake the amount of damage to obtain a higher pay out. Saying that though if Homer has incurred expenses and injuries as a result of the accident, why should he not claim and how would it be unnecessary?
In reality, any claim that gets to court would have had to use the pre action protocols and the CPR and these would root out most unnecessary/weak claims. My point is therefore that any action taken against another would never be unnecessary as otherwise the CPR would prevent it from taking place. The law and the judges are not total idiots.
Since the Police take no action to punish the woman driver, sueing her might just achieve this aim and make her more careful.
Anyway, Homers thread isn't about our difference of opinions so I won't reply any further on here. If we want to argue with me about it then start a new thread. :)

Had a call today to say the car will be written off, the repair cost was estimated at £4k!
The other parties insurance company has been very good so far, they've extended my hire car cover for another week and upgraded it to a larger car (I mentioned I had planned to pick up some large car parts this weekend - which is true!)
The assessor seemed quite a reasonable chap when I was speaking to him but he did say he has to use Glass's to provide a valuation :( He said that the car was in excellent condition and much lower mileage than is normal for these, so provided a 'favourable' valuation...
I paid £1450 for the car 5 months ago. I cannot find similar spec/age car with low mileage anywhere to compare it to.. there are some larger engine ones for sale on auto trader, but with massive mileage for £1.5-£2k...
What would be fair to accept as an offer for the car? I would be satisfied with getting back what I paid...

As far as i am aware, you can wait until a reasonable offer e.g what you find on autotrader would be fine. You have the right to a hire car until you have had the cheque for 5 days.

Fingers crossed they don't mess about, but we'll see!
It's been a week since the crash and I've had no problems at all with my neck, it only hurt on the evening but has been fine since. The bruises are more of less gone now and feel 100% healthy :) The impact speed couldn't have been more than 25mph, so was pretty minor, if it was 40+mph it would probably be a different story.
only seen this now, bummer mate, really scares me to see things like this as its now comming into biking season, makes you think!!

If they have taken the blame then you should in no way be out of pocket and you should also be receiving a car that is exactly the same as the one you lost, regardless of cost.
The valuation thing is pointless, if you can't get the car you want for the price they quote make sure you give them a piece of your mind. To save you time later get as many prints of the cars you are looking at on autotrader to send to the insurance company as proof that their valuation is way off.

I've got a cheapy volvo estate for sale in the same price bracket chap :)
Bloody women drivers, is yours a riteoff, looks pretty bad.
I have been offered £1500 for the car, which is about £50 more than it cost me (got it cheap off my brother in law).
I cannot find a replacement which is a PITA, but there are some better models for only a few hundred more.
What do you think - accept this offer or not? It seems fair as that was about what the car was worth, but it's going to cost me in the long run...
If it's their first offer, try for more.
You'll need proof that you can't buy another for that though. Adverts of equivalent cars would do.
Do not accept the offer. Check autotrader for absolute minters and print off the highest price ones (as many as you can find in the price range your looking for).
Send them in along with your formal rejection in letter form and you should get somewhere.
It will be very hard to replace the car you had regardless of how much you got it for originally. Its not your fault so let them pay accordingly.

I had a really good search this evening for similar cars and found only two that were similar, both were priced below £1500 so it seems this is a good offer. I'll be accepting it.
Also think I have secured a '98 528i SE Touring manual (new model) for only £1600, less miles than the 518i too! Bonus :)
